Terms & Conditions

Last updated: 30 September 2026

These Terms and Conditions ("Terms") govern your use of the Daystaz website (www.daystaz.com), the Daystaz mobile app, our customer support channels and chat assistant, and related services (the "Platform"), and any booking you make through it.

The Platform is operated by Daystaz Pty Ltd (ACN 701 746 465, ABN 74 701 746 465) ("Daystaz", "we", "us" or "our"). "You" means the person using the Platform or making a booking.

By using the Platform, creating an account or making a booking, you agree to these Terms. Please read them carefully.

1. About Daystaz

1.1 Daystaz is an online booking platform that lets you find and book hotel rooms and other accommodation for use during the day, by the hour or for a short period, rather than overnight ("Day Stays"). Daystaz may also offer other accommodation products from time to time.

1.2 The accommodation on the Platform is supplied by independent hotels, motels, serviced apartments and other accommodation businesses ("Accommodation Providers"). Daystaz does not own, operate or manage that accommodation.

2. Our role

2.1 Daystaz acts as an intermediary. We provide the Platform through which you can view availability and make a reservation with an Accommodation Provider. When you make a booking, your contract for the accommodation itself is with the Accommodation Provider.

2.2 Daystaz does not charge you for your stay. You pay the Accommodation Provider directly when you arrive (see clause 9).

2.3 Daystaz receives a commission or fee from Accommodation Providers for bookings made through the Platform. The order in which properties are displayed may be influenced by factors including relevance, availability, price, customer reviews, the commission paid and paid promotional placements. Where a listing is a paid promotion, we will label it as such.

2.4 In addition to providing the Platform, Daystaz may:

  • send booking confirmations, reminders and updates;
  • pass messages between you and the Accommodation Provider;
  • help you if something goes wrong with a booking; and
  • offer promotions.

2.5 Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded (see clause 25).

3. Who can use Daystaz

3.1 You must be at least 18 years old and able to enter into a legally binding contract to make a booking.

3.2 The person named on the booking (the "Lead Guest") must be at least 18 years old, must be present at check-in and is responsible for the booking and for everyone staying with them. Accommodation Providers are not required to honour a booking made by, or for, a person under 18.

3.3 Guests under 18 may only stay if they are accompanied by the Lead Guest or another responsible adult and the Accommodation Provider's policies allow it.

3.4 You must not use Daystaz:

  • for any fraudulent or unlawful purpose;
  • to make false, speculative or duplicate bookings, or bookings you do not intend to use;
  • to impersonate another person;
  • to resell bookings or use the Platform for commercial purposes without our written consent;
  • to copy, scrape or extract data from the Platform by automated means; or
  • to interfere with, damage or disrupt the Platform.

4. Your account

4.1 You may need to create an account to make or manage some bookings. You can create an account with your email address or by signing in with Google or Apple. If you use a sign-in provider, its own terms also apply to that sign-in.

4.2 You are responsible for:

  • providing accurate and up-to-date information, including your name, email address and mobile number;
  • keeping your password secure and not sharing your account; and
  • telling us promptly if you suspect anyone has used your account without permission.

4.3 You are responsible for activity on your account, except activity that happens because of our failure to take reasonable care.

4.4 You can close your account at any time by contacting us. Closing your account does not cancel any upcoming bookings unless you also cancel them.

5. Listings

5.1 Each listing includes information supplied by the Accommodation Provider, such as room descriptions, photographs, facilities, available time blocks, prices, check-in and check-out times, occupancy limits, accessibility information and property rules.

5.2 Accommodation Providers are responsible for keeping their listings accurate and up to date. We may review, edit or remove listings, but we cannot guarantee every detail supplied by an Accommodation Provider is free from error.

5.3 If you think a listing is materially wrong or misleading, please tell us.

6. Making a booking

6.1 To make a booking you will select a property, room type, date and time block, enter the Lead Guest's details and the number of guests, review the price and booking conditions, and submit the booking.

6.2 We do not take payment or card details when you book.

6.3 Your booking is confirmed when you receive a booking confirmation from Daystaz by email or SMS, or in the Platform. Please check it straight away and contact us if anything is wrong.

6.4 Keep your booking confirmation, as you may need to show it at check-in.

7. Day Stays

7.1 Your booking confirmation will show your booked check-in time, check-out time and stay duration, and any special conditions.

7.2 A Day Stay does not include an overnight stay. Your room must be vacated by the check-out time shown in your confirmation.

7.3 Rooms may be prepared for your arrival at the start of your time block. Early check-in is not guaranteed and is at the Accommodation Provider's discretion.

7.4 If you stay beyond your check-out time, the Accommodation Provider may charge you for the extra time in line with its own late check-out policy, which should be shown in the listing or booking conditions. Any such charge is payable directly to the Accommodation Provider.

7.5 The number of guests must not exceed the number shown in your booking or the room's maximum occupancy. Additional guests are at the Accommodation Provider's discretion and may incur extra charges payable to the Accommodation Provider.

8. Prices

8.1 Prices on the Platform are in Australian dollars and include GST, unless stated otherwise.

8.2 Before you book, we will show you the total price payable for the stay, including any mandatory fees we have been told about by the Accommodation Provider.

8.3 Daystaz does may charge customers a booking or service fee. If this changes, any fee will be clearly shown before you book.

8.4 The Accommodation Provider must not charge you more than the confirmed price for the room and time block you booked. If you are asked to pay more, please contact us.

8.5 Optional extras and incidental charges are not included in the price unless stated, and are payable directly to the Accommodation Provider. These may include food and drink, minibar, parking, room upgrades, late check-out, additional guests and damage.

9. Paying at the property

9.1 You pay the Accommodation Provider directly for your stay, usually at check-in, using a payment method it accepts.

9.2 Card surcharges, if any, are set by the Accommodation Provider, must comply with applicable law and are payable to the Accommodation Provider.

9.3 The Accommodation Provider may ask for a security deposit or a pre-authorisation on a credit or debit card at check-in. Where this applies, it should be shown in the listing or booking conditions. Deposits and pre-authorisations are arranged between you and the Accommodation Provider, and the timing of any release depends on the Accommodation Provider and your card issuer.

9.4 Receipts and tax invoices for your stay are issued by the Accommodation Provider.

10. Cancelling a booking

10.1 You can cancel a booking free of charge at any time up until your booked check-in time.

10.2 Please cancel through the Platform, or by another method shown in your booking confirmation, as soon as you know you cannot attend, so the room can be offered to someone else.

10.3 Because you pay at the property, you will not be charged when you cancel.

11. No-shows and late arrival

11.1 If you do not arrive and have not cancelled before your booked check-in time, the booking is a "no-show".

11.2 You will not be charged for a no-show. However, repeated no-shows may lead to restrictions on your account under clause 18.

11.3 If you are running late, please contact the Accommodation Provider or Daystaz. Arriving late does not extend your check-out time, and if you have not arrived within any grace period shown in your booking conditions, the Accommodation Provider may release the room.

12. Changing a booking

12.1 Unless the Platform lets you change a booking directly, to change the date, time, room or number of guests you will need to cancel your booking and make a new one.

12.2 A new booking is subject to availability and to the price at the time you make it.

13. If the property cannot honour your booking

13.1 Occasionally an Accommodation Provider may be unable to honour a confirmed booking, for example because of overbooking, a closure, maintenance, safety issues, incorrect availability or an emergency.

13.2 If we are told about this, we will let you know as soon as reasonably possible and, where we reasonably can, help you find a suitable alternative.

13.3 If you arrive and the Accommodation Provider refuses to honour a confirmed booking without a valid reason, please contact us straight away. You will not be charged for the booking you could not use, and you keep any rights you have against the Accommodation Provider under the law.

14. Check-in

14.1 At check-in, the Accommodation Provider may ask the Lead Guest to show:

  • current government-issued photo identification;
  • the booking confirmation; and
  • a credit or debit card for payment, a security deposit or incidentals.

14.2 Please check the Accommodation Provider's check-in requirements before you arrive. If you cannot meet a lawful requirement that was clearly disclosed to you, the Accommodation Provider may refuse check-in.

15. Property rules and your conduct

15.1 You and your guests must follow the Accommodation Provider's reasonable property rules, including rules about smoking, noise, visitors, pets, parties, occupancy and safety.

15.2 You must not use accommodation booked through Daystaz for:

  • any illegal activity;
  • violent, threatening or abusive behaviour;
  • parties or events not permitted by the Accommodation Provider;
  • commercial activities the Accommodation Provider prohibits; or
  • anything that creates an unreasonable risk to people or property, or unreasonably disturbs others.

15.3 The Accommodation Provider may refuse service or require you to leave if you or your guests seriously breach its rules or the law.

15.4 Daystaz does not tolerate illegal activity on or through the Platform and will cooperate with law enforcement where required or permitted by law, in line with our Privacy Policy.

16. Incidental charges and damage

16.1 You must pay the Accommodation Provider for any extras you or your guests use during your stay.

16.2 You are responsible for loss or damage to the property caused intentionally or negligently by you or your guests, in accordance with the law. The Accommodation Provider should give you reasonable evidence of any damage it claims.

16.3 Daystaz may help pass on communications about unpaid charges or damage claims, but does not decide legal responsibility for them.

17. Reviews

17.1 After your stay, we may invite you to review the Accommodation Provider. Only customers who have booked and completed a stay through Daystaz can post a review of it.

17.2 Your review must be your own honest experience. It must not be false, misleading, defamatory, threatening, discriminatory, obscene, or include personal information about anyone else.

17.3 We do not pay for, or offer rewards in exchange for, reviews.

17.4 We may moderate reviews and may decline or remove a review that breaks these rules. We will not remove a review just because it is negative. Accommodation Providers may report a review they believe breaks these rules, and we will assess the report.

17.5 By posting a review, you give Daystaz a non-exclusive, royalty-free, worldwide licence to use, display and reproduce it on the Platform, on Daystaz's social media pages and in connection with Daystaz's services. Reviews are published with your first name or display name and the date of your stay.

18. Restricted and closed accounts

18.1 We may restrict, suspend or close your account, or refuse future bookings from you, if we reasonably believe you have:

  • repeatedly failed to turn up for bookings without cancelling (for example, 3 or more no-shows within 12 months);
  • failed to pay an Accommodation Provider for a stay or for charges properly owed;
  • caused intentional or negligent damage to a property;
  • been violent, threatening or abusive towards Accommodation Provider or Daystaz staff, or other guests;
  • engaged in fraud or illegal activity;
  • seriously or repeatedly breached these Terms; or
  • otherwise created a serious safety risk.

18.2 Where reasonably practicable, we will tell you why. If you think a restriction is wrong, you can ask us to review it by contacting us, and we will consider your request and let you know the outcome within a reasonable time.

18.3 A restriction does not affect any rights you have under the law in relation to bookings already made.

19. Promotions

19.1 From time to time, we may offer promotional codes, discounts or other offers. Any discount will be applied to the price shown in your booking confirmation, and you pay the discounted price at the property.

19.2 Unless the specific promotion terms say otherwise, promotions:

  • have no cash value and cannot be transferred;
  • are valid only until the stated expiry date;
  • are limited to one use per customer and one per booking;
  • may apply only to selected properties, dates or time blocks; and
  • cannot be combined with other offers.

19.3 If you cancel a booking that used a promotional code, the code is not reinstated unless we say otherwise.

19.4 We may refuse or cancel a promotion that we reasonably believe has been obtained or used fraudulently or in breach of its terms.

20. Communications

20.1 By making a booking, you agree that we or accommodation providers may contact you by email, SMS, push notification or phone about your booking, your account and service matters.

20.2 We will only send you marketing messages if you have consented to receive them. You can opt out at any time by using the unsubscribe link or by contacting us.

21. Platform availability and third-party services

21.1 We aim to keep the Platform available and working, but we do not guarantee uninterrupted or error-free access. Access may be affected by maintenance, updates, internet or third-party outages, security incidents or other events.

21.2 The Platform uses third-party services such as mapping, messaging, analytics, hosting and security providers. Your use of some of these services may also be subject to their own terms and privacy policies.

21.3 If you download the Daystaz app from the Apple App Store or Google Play, the terms of that store also apply to your download and use of the app.

22. Our chat assistant

22.1 The Platform includes an AI-powered chat assistant that can answer questions, help you find hotels and help you manage your bookings. It will identify itself as automated.

22.2 The chat assistant's answers are for general guidance. If anything it tells you differs from your booking confirmation, the listing or these Terms, the booking confirmation, listing and these Terms apply. Please check important details before relying on them.

22.3 You can ask the chat assistant to put you in touch with a member of our team at any time. The chat assistant will not restrict or close your account without human review.

22.4 Please do not share sensitive information, such as health information, with the chat assistant. Chat conversations are handled as described in our Privacy Policy.

23. Intellectual property

23.1 The Platform and its content, including the Daystaz name, logo, branding, design, software, text, graphics and databases, are owned by or licensed to Daystaz.

23.2 You must not copy, reproduce, distribute or commercially use any of this material without our written permission, except as permitted by law.

24. Privacy

24.1 We handle your personal information in accordance with our Privacy Policy, available at www.daystaz.com, and the Privacy Act 1988 (Cth).

24.2 To make and manage your booking, we share relevant details, such as the Lead Guest's name, contact details, booking details and number of guests, with the Accommodation Provider and with service providers who help us run the Platform.

25. Australian Consumer Law and our liability

25.1 Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded.

25.2 The Accommodation Provider is responsible for the accommodation and related services it supplies, including the condition, safety and cleanliness of the property and anything that happens there. Daystaz is responsible for the services it supplies, namely the Platform and its booking and customer support functions.

25.3 To the extent permitted by law, Daystaz is not liable for:

  • any act or omission of an Accommodation Provider, including any loss, injury, theft or damage that occurs at a property;
  • any loss arising from events beyond our reasonable control (see clause 26); or
  • any indirect or consequential loss that was not reasonably foreseeable.

25.4 Any exclusion or limitation of our liability in these Terms applies only to the extent permitted by law.

26. Events beyond our control

Neither Daystaz nor you will be liable for a failure or delay in performing obligations under these Terms caused by events beyond reasonable control, such as natural disasters, extreme weather, pandemics, government orders, power or network outages, cyber attacks or industrial action.

This clause does not affect your free cancellation rights under clause 10.

27. Complaints and help

27.1 If something goes wrong during your stay, please raise it with the Accommodation Provider straight away, as it is usually best placed to fix it. If it cannot be resolved, contact Daystaz as soon as reasonably possible.

27.2 To help us look into a complaint, please give us your booking number and any relevant details, photos, receipts or correspondence.

27.3 We will acknowledge your complaint, assess it fairly, and use reasonable efforts to help resolve it.

27.4 Contact our customer support team at:

  • Email: support@daystaz.com
  • In-app or website chat: our chat assistant can help with common questions, and you can ask to be put in touch with a member of our team.

28. Disputes

28.1 If a dispute arises, please contact us first so we can try to resolve it in good faith.

28.2 Nothing in this clause stops you from contacting Consumer Affairs Victoria or another consumer protection agency, or from applying to a court or tribunal such as the Victorian Civil and Administrative Tribunal (VCAT).

29. Changes to these Terms

29.1 We may update these Terms from time to time. The current version will be published on the Platform with its effective date, and we will notify you of material changes before they take effect where reasonably practicable.

29.2 The Terms in force when you made a booking will apply to that booking, unless the law requires otherwise or you agree to the change.

30. General

30.1 These Terms are governed by the laws of Victoria, Australia. You and Daystaz submit to the non-exclusive jurisdiction of the courts and tribunals of Victoria. This does not limit any rights you have under laws that apply regardless of this clause.

30.2 If any part of these Terms is invalid or unenforceable, it will be read down or severed to the minimum extent necessary, and the rest of these Terms will continue to apply.

30.3 If we do not enforce a right under these Terms, that does not mean we have waived it.

30.4 These Terms, together with the booking conditions shown when you book, our Privacy Policy and any applicable promotion terms, form the entire agreement between you and Daystaz about your use of the Platform.
